The House of Representatives of the USA have voted 407 to 0, approving the "Consumer ProductSafety Modernization Act", which is said to be the strongest consumer protection legislation sincethe creation of the Consumer Product Safety Commission (CPSC) in 1972. The next step is for theSenate to pass the bill. The Senate version has been placed on the calendar and is likely to beheld off until early next year at the earliest.
Ban on Children's Products containing Lead, Lead Paint:
1. Bans lead in products intended for children under 12 years of age. Once fully phased in, the billwould lower the limit from 600 ppm to 100 ppm total lead content by weight for any accessiblepart of the product other than surface coating. It also mandates that the CPSC periodicallyreviews and revises this standard to require the lowest amount of lead:
o 600 ppm effective 180 days after the date of enactment;
o 300 ppm effective 2 years after the date of enactment;
o 100 ppm effective 4 years after the date of enactment.
2. Modify 16 CFR 1303.1:
o reduce the limit applicable to lead paint from 0.06% to 0.009%;
o apply the standard to all children's products as defined;
o reduce the limit for paint and other surface coating on children's products and furniture to 0.009 mg/cm².
Third Party Certification of Children's Products:
Mandates pre-market testing of children's products for lead and other hazards by third partycertified laboratories. Effective 1 year after the date of enactment of the Act, every manufacturer ofa children's product and the private labeler shall:
1. have the product tested by an independent third party qualified to perform such tests;
2. issue a certificate to certify that such product conforms to the applicable standards or rules.
Tracking Labels for Children's Products:
Effective 1 year after the date of enactment of the Act, the bill requires manufacturers to placedistinguishing marks on products and packaging to aid in recall of children's products. |
